A lightning strike on an airplane can be considered an extraordinary circumstance in the event of a significant delay. A corresponding judgment was published by the European Court of Justice (ECJ) on Thursday. The ECJ dealt with this issue at the request of the Regional Court of Korneuburg, after a flight of Austrian Airlines (AUA) was struck by lightning in March 2022. As a result, a passenger arrived in London with a delay of over 13 hours.
